Acceptance of these terms

These Terms of Use are an agreement between you and One Term Only (“One Term Only,” “we,” “us”) governing your use of this website and any related features, including the pledge. By using the site or submitting a pledge, you agree to these terms. If you do not agree, do not use the site.

Eligibility and scope

The site is intended for United States residents who are of voting age or approaching it, and it is operated from the United States. It is not a government website, a government petition, a ballot initiative, or a voter-registration service. If you use the site from outside the United States, you do so on your own initiative and are responsible for compliance with your local law.

Definitions

• The pledge is the published pledge wording, identified by version, that a signer affirms.
• A pledge record is the row created when you submit and verify a pledge. There is no user account and no password.
• The count is the public total of verified, non-withdrawn pledge records, described on the Progress and counting methodology page.

The pledge is voluntary

Taking the pledge creates no legal obligation of any kind. It is a statement of present voting intention. You may change your mind at any moment, with or without withdrawing your record. No one can see, verify, or enforce how you vote, and we do not try to.

Your representations

• You submit only an email address that you personally control.
• You submit one pledge record, for yourself, and not on another person’s behalf.
• Any name, alias, state, or ZIP code you provide is accurate to your knowledge.
• You are responsible for keeping your management link private; anyone with a valid, unexpired link can act on your record.

Prohibited conduct

• Inflating, distorting, scraping, or otherwise interfering with the count.
• Automated, scripted, or bulk submission, and any use of the site by bots except well-behaved search crawlers.
• Impersonating another person, or representing this organization without written authorization.
• Probing, scanning, load-testing, or attempting to bypass security or access controls, including administrative areas.
• Uploading malicious code, or interfering with the operation or availability of the site.
• Using campaign materials to attack a specific officeholder as corrupt. The argument here is structural, not personal.
• Using the site for unlawful purposes, harassment, or to violate anyone’s rights.
• Harvesting personal information from the site by any means.

Your submissions

You keep whatever rights you have in the information you submit. By submitting, you grant us a non-exclusive, worldwide, royalty-free license to store and process that information to operate the pledge, and to include it in aggregate or de-identified totals. Your name is displayed publicly only if you affirmatively choose public display, and you may revoke that choice at any time. If you send us a message, feedback, or a research correction, you allow us to use it to improve the project, without obligation to compensate you.

Intellectual property

The site’s text, design, framework document, diagrams, and marks are owned by One Term Only or its licensors. You may read, quote with attribution, link to, and share the material provided on the site for non-commercial civic purposes, including the sharing assets we publish for that purpose. You may not copy the site wholesale, sell our material, or use our name or marks in a way that suggests endorsement or affiliation without written permission.

Third-party content and links

We link to and summarize outside articles, research, and videos. Linking is not endorsement of everything a source says, and we do not control third-party sites or their terms. Where we present evidence, we also present counterevidence; see Evidence and tradeoffs.

Privacy

Our handling of personal information is described in the Privacy Policy, which is incorporated into these terms.

Electronic communications

By submitting a pledge or contacting us, you consent to receive communications from us electronically, including transactional email about your record. Marketing email requires a separate, revocable consent and always includes a one-click unsubscribe. Electronic notices satisfy any legal requirement that a communication be in writing.

Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the site will be uninterrupted, error-free, or secure. Content is provided for civic information only and is not legal, electoral, tax, or financial advice.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ONE TERM ONLY AND ITS ORGANIZERS, VOLUNTEERS, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, OR LOSS OF GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless One Term Only and its organizers, volunteers, and contractors from claims, damages, and reasonable legal fees arising out of your misuse of the site, your violation of these terms, or your violation of any law or third-party right.

Governing law and dispute resolution

These terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law rules. Before filing anything, you agree to contact us at info@onetermonly.org and attempt in good faith to resolve the dispute informally for at least 30 days. If that fails, the state and federal courts located in Wyoming have exclusive jurisdiction, and both parties consent to venue there. Nothing prevents either party from seeking relief in small claims court.

Termination and suppression

We may suppress a record, exclude it from the count, or restrict access to the site where we identify abuse, duplicate or automated submission, or violation of these terms. Such actions follow review and are logged. You may end your participation at any time through Manage or withdraw your pledge. Sections that by their nature should survive termination — intellectual property, disclaimers, liability, indemnification, and disputes — continue to apply.

Copyright complaints

If you believe material on this site infringes your copyright, send a notice to info@onetermonly.org identifying the work, the material and its location, your contact information, a statement of good-faith belief that the use is unauthorized, a statement that the notice is accurate, and your signature. We remove or disable material in response to valid notices and accept counter-notices.

General terms

If any provision is found unenforceable, the rest remains in effect and the unenforceable part is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a transfer of the project’s operations. Neither party is liable for delays caused by events beyond its reasonable control. These terms, together with the Privacy Policy and Disclaimer, are the entire agreement between us about the site.

Changes to these terms

We may update these terms. When we do, we update the effective date at the top of this page, and for material changes we notify people with an active pledge by email. Continued use after an update means you accept the updated terms.
